What We Do at Stark ADR

Understanding Mediation

Mediation is a flexible process that uses various techniques to help parties resolve disputes. The mediator’s role is to guide the conversation and help the parties reach a fair and mutually acceptable agreement. While many mediations involve in-person meetings, we also offer video conferencing and shuttle mediation for situations where direct interaction is not possible.

Successful mediation requires compromise and active participation from all parties. It involves working together to identify common ground and make practical decisions that lead to a resolution.

Mediation is typically faster, less expensive, and more effective than going to court. It also offers confidentiality and allows parties to create tailored solutions that meet their unique needs.

Our Approach

Our comprehensive dispute resolution toolkit includes negotiation, collaboration, conciliation, and arbitration. We work closely with all participants to explain each method and customize our approach based on their preferences. This might include virtual mediation for long-distance clients or shuttle mediation to accommodate sensitive dynamics.

Once an agreement is reached, it can often be filed with the court and enforced as a court order. However, this is not a guaranteed outcome or cannot be promised by Stark ADR.

When Mediation Isn’t Enough

If mediation does not result in a resolution, we offer arbitration—an efficient and cost-effective process similar to having a private judge make a binding decision. We also offer Med/Arb, a hybrid model in which parties first attempt to resolve their issues through mediation and, if any matters remain unresolved, proceed to arbitration. This approach ensures that all issues are addressed and settled.

At Stark Alternative Dispute Resolution, we remain neutral. We do not represent either party. Our role is that of an impartial facilitator dedicated to reducing conflict and helping parties reach meaningful resolutions.
